Full Privacy Statement

This Privacy Policy of the McNaughton-McKay Electric Company ("McNaughton-McKay," "we," "us," or "our") describes its policy for treatment of Personal Information obtained by, through or stored at www.mc-mc.com and the McNaughton-McKay mobile application (the "Site") (individually and collectively, the "Site"). This Privacy Policy applies only to the Site, and it applies to the Site regardless of the platform on which it is used. "You" in this Privacy Policy means you personally. If you visit other sites operated by McNaughton-McKay or other sites linked to the Site, the privacy policy for the Site will not control the practices for collecting and using personal information on those other sites. Additionally, unless explicitly referenced herein, the Privacy Policy does not apply to McNaughton-McKay's practices for collecting and using personal information offline or from sites, software, or applications other than the Site.

 

Not Intended for Children: The Site is not directed to or intended to be used by children younger than 13 years of age. It is directed to residents of the United States over the age of eighteen and capable of entering into binding contracts. McNaughton-McKay does not knowingly collect personal information from children under the age of 13.

What is "personal information?"

"Personal information," as used in this Privacy Policy, means information from which you can reasonably be identified.

 

What information do we collect?

Information You Provide.

We collect personal information that you provide voluntarily to McNaughton-McKay. Personal information requested might include identifiers, for example, your name, business address, email address, and title. Further, any commercial information provided when signing up for the McNaughton-McKay newsletter, training or app registration, or when using our contact request form may constitute personal information. McNaughton-McKay offers you the opportunity to purchase electrical equipment/parts through the Site and you pay for these items with certain credit cards. We outsource credit card processing and transactions to CenPos, who represents compliance with applicable Payment Card Industry standards. When you pay for a product or other service by credit card, you will be providing your credit card number to CenPos. McNaughton-McKay does not collect sensitive credit card information on the Site. We may, however, collect certain information about your transaction and purchase history as a result of your using the Site. As an added layer of protection, any credit card information we collect is encrypted via a tokenization method.

Automatically Collected Information.

Navigational Information. When you visit the Site, we may capture certain information automatically (even if you do not voluntarily provide us with personal information). This information may include internet or other electronic network activity information, such as your Internet protocol ("IP") address, location-based information, browser type, time and date of access and pages accessed, linking information, click stream, page visits, page views, and website log files. Navigational information may include location-based information, which we use to verify your location and provide you information that is geographically useful to you. You may have the ability to disable your device's GPS or other location-based information transmitter. If you choose to disable your device's ability to transmit geolocation information, you may not be able to take advantage of some of the Site's offerings. Navigational information is also captured through third party analytics and ad services.

We may match non-personal navigational information with other information we have collected from you during the course of your visit to the Site. Through this process inferences may be drawn from the information identified above and below reflecting your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. If that other information renders such navigational information identifiable to you or a particular device, then it will become personal information and will be treated as such pursuant to this Privacy Policy.

Cookies. We collect information using “cookie” technology. Cookies are small packets of data that a website stores locally so that your computer will “remember” information about your visit. We use both first- and third-party session cookies and persistent cookies. We use session cookies to make it easier for you to navigate our services. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time or until you delete them. Persistent cookies also enable us to track and target the interests of our visitors to personalize the experience of our products and services. Who can see my personal information?

Personal information you provide to us in connection with your account on the Site may be visible to others within your same organization, designated as "super users," who are given permission to see it. Your organization is responsible for verifying the identity of each such individual and confirming that he or she is authorized by the organization to be a super user before granting permission to see the information of others within his or her organization. Your information will not be visible to the public, but may be shared with third-parties in accordance with this Privacy Policy.  

 

How does McNaughton-McKay use the information it collects?

We generally use personal information, including personal information, identifiers, commercial information, internet or other network activity data, and geolocation data : to advise you of opportunities available on our site or elsewhere; to respond to requests for products or services; to provide information about your account and the proper use or misuse of the Site; to process technical or administrative issues or to communicate regarding those issues; to improve, expand, or otherwise adjust our services. When you use our customer service functions or otherwise contact or request contact from our customer service staff, we may collect information about the questions or concerns you submit.

 

Analytics and Advertising

Please note that we may collect navigational information using a third-party web analytics tool such as Google Analytics and Matomo. Google Analytics collects information such as the IP address, how often the visitors visit the Site, the pages visited, and other sites visited prior to coming to the Site. To the extent that use of these tools involves use of cookies, and to the extent that any information collected by us using those tools, or collected by third parties using such tools and transferred to us by them, is or becomes personal information held by us, we use it in accordance with the terms of this Privacy Policy.

Google Analytics. McNaughton-McKay uses Google Analytics principally to understand how the Site is used and to improve it. Google, through Google Analytics, may collect navigational information, such as Your IP address, that is identifiable to you or your device. We also use Google Analytics to review data on website visits including: browser information, platform information, page information, visit duration, referring site, time of visits, and click throughs. Matomo. McNaughton-McKay uses Matomo principally to better understand what customers are searching for, to see what new features to implement, and/or to provide suggested products and relevant ads on shopping experience based on purchase history. The data collected, might include personally information such as IP address, navigational activity and transactional activity of both known and anonymous users. Matomo works by collecting the information and performing its functions on our servers, rather than externally. Matomo uses cookies to collect information related to your use of the Site. In connection with marketing related activities, we may monitor and collect information posted on our accounts or linked to us on third party operated social networks or other web offerings (such as Twitter, YouTube, LinkedIn, Facebook, Instagram or Google).

 

How does McNaughton-McKay treat "Do Not Track" requests?

Users may have the option of enabling "Do Not Track" in their browsers, which sends a signal to websites that the user does not want to be tracked across multiple websites. McNaughton-McKay does not track who have enabled "Do Not Track." However, third parties who have a presence in or through our website, such as advertising partners or manufacturer partners, may engage in such tracking.

 

Does McNaughton-McKay use personal information for advertising purposes?

McNaughton-McKay may use your personal information for advertising purposes (with your affirmative consent, where required by law). McNaughton-McKay does not share personal information with third-party advertising companies, except as stated in our Privacy Policy. We may share information with other entities as part of joint marketing efforts and with online third party mailing or marketing companies to help us in our efforts to contact and communicate with you. McNaughton-McKay may use information connected with your account, such as your purchase history, to provide you with suggestions of McNaughton-McKay or affiliate product offerings which may interest you. Marketing communications will always provide a method for you to opt-out of future marketing communications.

 

Under what circumstances does McNaughton-McKay disclose or transfer personal information to others?

There are circumstances where we will transfer and/or disclose your personal information to third parties. McNaughton-McKay does not sell or rent consumer personal information. Those circumstances, subject to the limits of applicable law and in addition to other circumstances that may be listed in this Privacy Policy, are as follows:

Subsidiaries and Affiliates: McNaughton-McKay may transfer personal information to its parent, subsidiaries, and corporate affiliates for purposes related to McNaughton-McKay service offerings as such offerings may change and develop over time.

Site Consultants and Service Providers: McNaughton-McKay transfers, or your visit to the Site will result in such transfer of, personal information to third-party service providers that may be hosting or housing data on behalf of McNaughton-McKay or otherwise acting on its behalf as a datacenter (such as providers of hosting, cloud, technology outsourcing and support services). Additionally, McNaughton-McKay may disclose personal information to the extent that our service providers require access to our databases, or the information contained in our databases, to service McNaughton-McKay and the Site.

Identity Verification Services. We share your information with third party identity verification services in an effort to prevent fraud. We share your information with Kount Inc. ("Kount") to perform transaction monitoring and screening for fraud prevention. Information shared with Kount is treated by Kount in accordance with its Privacy Policy, available at https://kount.com/legal/privacy-policy/.

Legal Compulsion and McNaughton-McKay's Protection: McNaughton-McKay reserves the right to release personal information in response to a subpoena or otherwise when we believe that the law requires us to do so or when we believe it is necessary to resolve disputes or to protect and/or enforce the rights, property interests, or safety of McNaughton-McKay, our users or others.

Reorganization or Sale of McNaughton-McKay: In the event that McNaughton-McKay is merged with or becomes part of another organization, or in the event that McNaughton-McKay is sold or it sells all or substantially all of its assets, or a brand or line of its business, the information you provide may be one of the transferred assets for use by the acquiring entity.

As Otherwise Allowed by Law: We may transfer personal information to third parties where we are expressly authorized by applicable law to do so.

With Your Affirmative Consent: We may transfer personal information to third parties in accordance with your affirmative and advance written consent (which may be electronic).


How do you keep my personal information secure?

Although we cannot guarantee that our or our third-party service providers' servers are impenetrable, we have established and implemented reasonable safeguards designed to secure the information we collect online. Where we use third-party service providers to collect, store, or process data, we attempt to use third-party service providers who likewise also establish and implement reasonable procedures. One method we use is, Secure Socket Layers (“SSL”), an industry standard for secure website transactions. When you visit the Site your browser address (URL) changes from HTTP to HTTPS, and the browser may display a lock or key symbol on its task bar. Our SSL-protected applications use 128-bit encryption.

 

Does the Site link to third party sites?

McNaughton-McKay may present the opportunity to link to third party sites. When using third party sites, you should review such party's sites to understand how they treat personal information. Unless expressly stated otherwise, we do not control, endorse or necessarily agree with any of these third party sites. While the Site may link to third party sites that track your actions on the Site, no personal information is provided by the Site to these third party sites.

How long do you keep my information?

McNaughton-McKay will keep your personal information for as long as necessary for the purposes we collected the personal information, or if longer, the amount of time permitted or required by law. Our goal is to establish a relationship with our customers so that they always regard us as a resource for the services we offer. We also note that our customers always have the right to request that their information be deleted from our files. We will attempt to honor these requests, subject to applicable law and our judgment that the information is not important for us to maintain for our internal record-keeping purposes for reasons other than continuing a commercial business relationship with you (e.g., for tax, accounting and other transactional purposes).

 

Suggestions and Ideas.
